Terms of Service

These Terms of Service ("Terms") govern your use of Pertch ("the Service"), operated by Pertch ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Pertch is a browser-based AI sales coaching tool that listens to your live calls (the meeting tab you share plus your microphone) and provides real-time coaching prompts. The Service requires Google Chrome or Microsoft Edge. Safari is not currently supported.

2. Account registration

You must provide a valid email address to create an account. Authentication is passwordless: we email you a one-time sign-in code, so no password is required. You are responsible for maintaining access to your email account and for all activity under your Pertch account.

3. Free trial

New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial, your account will pause until you choose to subscribe. No automatic charges will occur.

4. Subscription and billing

All plans are billed monthly and include every methodology and feature. Plans differ only by how many hours of live coaching you get each month:

• Starter: $39/month, 15 hours of live coaching per month
• Pro: $49/month, 20 hours of live coaching per month
• Power: $99/month, 45 hours of live coaching per month

Payments are processed securely by Stripe. You may cancel or change your plan at any time. Upon cancellation, your access continues until the end of your current billing period. No refunds are provided for partial billing periods.

5. Acceptable use

You agree to use Pertch only for lawful purposes. You may not:

• Use the Service to record, store, or distribute call audio without consent of all parties
• Attempt to reverse-engineer, decompile, or extract the underlying models or algorithms
• Share your account credentials or allow others to access your account
• Use the Service in a way that interferes with other users or our infrastructure
• Use the Service in violation of any applicable laws or regulations

6. Consent and compliance

You are solely responsible for ensuring that your use of Pertch complies with all applicable laws regarding call recording, monitoring, and consent in your jurisdiction. Some jurisdictions require all-party consent for any form of call monitoring. Pertch does not record call audio, but it does generate and store a text transcript of your session, so you should inform call participants that you are using an AI coaching tool if required by law.

7. Intellectual property

The Service, including its design, code, models, and branding, is owned by Pertch. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. Coaching prompts generated during your sessions are provided for your personal use and may not be resold or redistributed.

8. Data and privacy

Your use of the Service is also governed by our Privacy Policy. By using Pertch, you acknowledge that your call audio is processed in real time and never stored, while your session transcript and a post-call summary are retained privately in your account for 30 days and then permanently deleted, as described in the Privacy Policy.

9. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

10. Limitation of liability

Pertch provides coaching prompts as suggestions only. The Service does not guarantee sales outcomes, deal closures, or any specific business results. You are solely responsible for your sales conversations and decisions. To the maximum extent permitted by law, Pertch shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

11. Modifications to Terms

We may update these Terms from time to time. We'll notify you of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you disagree with changes, you may cancel your subscription and stop using the Service.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your access to the Service will cease and any associated data will be deleted in accordance with our Privacy Policy.
